APARTMENT TRANSFER POLICY

On occasion, residents find that their living circumstances no longer meet their needs. If during your lease term, you find you need to move, you have the ability to transfer to another available apartment unit within your building community at a nominal charge.

A transfer within the building is subject to following conditions:

Intra-Building Transfer 

• You must complete a new application and provide us the opportunity to conduct a complete credit and background check to verify that you qualify for the new apartment. The application fee of $35 is waived for residents who have a positive track record with our company, which includes a payment history of no late payments and no returned payments.

• Your account must be current and your tenancy in good standing.

• If the new apartment unit is available for move-in, you must be willing to take it immediately. We will provide you with access to both apartment units for up to seven days, so long as you pay the agreed upon rent for the more expensive unit for the seven days during which you have access to BOTH apartments. (For example, if you are moving from a studio to a one-bedroom, your new lease would start immediately and you would pay the rent for the new apartment. On the other hand, if you are moving from a one-bedroom to a studio, you would continue your old lease for seven days and your new apartment lease would begin AFTER the seven days is over. Under both options, you would have access to both apartments during the seven days period. This is our way of making the move easier for you.)

• You must be willing to pay the security deposit on the new apartment, even if it is higher than your existing security deposit. Your old security deposit, less legitimate charges for damage, will be transferred to the new apartment.

• If you have received a concession which requires you to remain in your apartment for a certain time period, you will be obligated to return the concession in accordance with the terms of your agreement.

Transfers Between Lightner Property Group Properties

If there is no suitable available apartment within your building or complex, we will allow you to move to another Lightner Property Group managed property without all of the standard costs associated with the breaking of a lease, so long as the following terms and conditions are met by you AND the buildings you are moving from and to each participate in our Transfer Program. Check with the main office to determine if the properties involved in your move are participants.

• You must complete a new application and provide us the opportunity to conduct a complete credit and background check to verify that you qualify for the new apartment. The application fee of $35 is waived for residents who have a positive track record with our company, which includes a payment history of no late payments and no returned payments.

• Your account must be current and your tenancy in good standing at the time you make the application for transfer.

• You must pay a service fee of $400 to Lightner Property Group for the costs associated with documenting your move and making arrangements between the involved building owners.

• If you received a concession which requires you to remain in your apartment for a certain time period, you will be obligated to return the concession in accordance with the terms of your agreement with the owner.

• If the owner paid a leasing commission at the time of your move-in, you must be willing to reimburse the owner for the balance of the unamortized commission. By way of example, if an agent was paid $1000 for your lease transaction and you have been in your apartment for 6 months, there are 6 months that are not yet amortized, or one-half of the commission. This one half of the commission would be due as reimbursement to the owner and you are financially responsible for this reimbursement as part of the agreement to allow you out of your lease.

• The owner of the property you are moving to, will be financial responsibility for making whatever payments are due to the current owner for the breaking of your lease beyond any concessions or commissions that are due back to the owner of the property you currently reside in.

• Your old security deposit, less legitimate charges for damage and unpaid charges, will be transferred to the new apartment. If there is a balance due or owning, you must pay it before you move into your new apartment.
